Buying in Thailand as a foreigner, in plain words
The rules are not complicated, but they are different from home, and the difference matters. This is the short version we give every buyer at the first meeting.
- Condominiums
- Foreigners can generally own a condominium unit in their own name, as long as foreign ownership in that building stays within the foreign quota, which is 49 percent of the total unit floor area. The purchase money normally has to come from abroad in foreign currency, and the bank records it.
- Villas and land
- Thai law does not generally allow a foreigner to own land in their own name. Most foreign buyers of villas therefore take a registered lease on the land, usually for up to 30 years, and own the house built on it. What happens after that term depends on the contract and on the law at the time.
- Taxes and fees
- Transfer fees and taxes are paid at the Land Office on the day of transfer, and who pays which share is part of the negotiation. Leases have their own registration fee. Ask your lawyer for the figures on the specific property before you agree a price.
- Your own lawyer
- We are agents, not lawyers, and we are paid by the seller. Before you sign or pay a deposit, have an independent lawyer check the title, the seller, the building permit and the contract. We can name several firms on the island. You are free to use none of them.

We opened Kiri Talay in 2016. The name means hill and sea, which is most of what there is here. We are small on purpose: whoever answers your first message is the person who will hand you the keys.

- We have been inside every home listed. The sizes are ours, measured with a laser, not copied from a brochure.
- Buyers and tenants pay us nothing. Our fee comes from the seller or the landlord, and we tell you what it is if you ask.
- We say what is wrong with a house. The steep road, the neighbour’s rooster, the roof that will need work in five years.
